| Ranes Consulting reserves the right to suspend or cancel a customer's access to any or all services provided by Ranes Consulting when Ranes Consulting determines that the account has been inappropriately used. If you are unsure whether any contemplated use or action is permitted, please send mail to info@ranesconsulting.com and we will assist you. Specific Use Policies 1. Unlimited Traffic Ranes Consulting's concept behind unlimited traffic is to provide our customers with unlimited bandwidth for active web pages. On rare occasions, a site's popularity and server usage may impair the performance of other sites on Ranes Consulting's servers. To ensure proper use, all files must be hyperlinked to files (.html, .jpg, .gif, etc.) stored on Ranes Consulting's server and vice versa. The user will be asked to remove any script that abuses system resources. 2. High Resource Policy Any site that is deemed as impairing the performance of our servers either by high disk utilization, high bandwidth usage, or high CPU usage will be entered into our "High Resource Customer" program. High Resource sites are sites that use an excessive amount of system resources such as bandwidth, storage or CPU utilization. It is Ranes Consulting's sole discretion to decide which sites are high resource sites. If you feel that your site my fall under this category, then please email info@ranesconsulting.com. Sites who have been deemed as a "High Resource" site will be subject to the following: $75 per month fee will be added to the user's current monthly fee. - Written authorization of billing must be faxed or mailed to Ranes Consulting. 3. Lawful and Ethical Use of Ranes Consulting's services may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material in violation of United States or California state regulations or laws, or by the common laws, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or any other statute. Ranes Consulting reserves the right to remove such illegal material from its server immediately. Ranes Consulting expressly forbids anyone from using Ranes Consulting's servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, or pornographic material, or any other material which we deem to be objectionable. The designation of any materials as such described above is left entirely to the discretion of the Ranes Consulting management. Ranes Consulting does NOT allow sites that provide points of distribution, participate in the act of or provide links to the following types of sites: • Adult Sites - Any erotic or pornographic material, links to adults sites, or advertisements for adult sites. Ranes Consulting defines Adult Material as any of the following: 1. Any photos or videos showing nudity on either males or females. 2. Any audio clips or text containing sexually explicit material. 3. Any file that is sexually explicit in nature. 4. Any sites with direct links to other sites containing such material. 5. Any site engaged in the sale of sexually explicit items. In addition, we reserve the right to determine what might be considered "sexually explicit" or "sexually related." If your site contains material that you are unsure about, please contact us. Ranes Consulting customers enjoy the assurance that if their IP addressing ever gets mixed up, their domain name will never pull up an adult site. In addition, Ranes Consulting customers know that their web site will never be "Black Listed" by web filtering services by virtue of sharing servers with adult sites. Unlike other web hosting facilities, we consistently have fast servers and clear networks that are not congested with users downloading pornographic images. • Pirated Software (warez) - Any software that is copyrighted and not freely available for distribution without cost, including ROMs, ROM Emulators and copyrighted MP3 files. Ranes Consulting defines warez as any of the following: 1. Illegal or pirated software that has not been purchased. 2. Software that was given to you a by a friend or coworker to make copies of and redistributed. 3. MP3's - This is the most common format of illegal copies of copyrighted music. •Hacking / Phreaking - Includes sites with materials, links, or resources for hacking, phreaking, viruses, anarchy, or any type of site that promotes or participates in the destruction or compromises the integrity of Ranes Consulting and it’s services. 4. Email Acceptable Use Ranes Consulting strictly prohibits harassment, whether through language, frequency, or size of messages. Forging of header information is not permitted. Ranes Consulting does not allow unsolicited mail. This includes Spamming and Bulk Mail sent to persons who have otherwise not requested to receive such mail. The reason for this is that not only is it generally frowned upon by the Internet community, but it also demands extra bandwidth to handle the effects of such mail. 5. End User Policy Ranes Consulting's services are intended for the end user only. Customers cannot sublease, subhost, or give away control of any portion of Ranes Consulting's resources. Violation of any of Ranes Consulting's rules and regulations could result in a warning, suspension, or possible account termination. Accounts terminated due to policy violations will not be refunded. 6. Payment Policies Advance payment is due in full by the 15th day of each month. The customer is responsible for all money owed on the account from the time it was established to the time it is terminated. Requests for termination must be submitted in writing to Ranes Consulting. Email notification will be sent to accounts not brought current by the 15th day of each month. Past due accounts that are not brought current within 7 days of the email notice are subject to suspension and possible account termination. Checks returned unpaid (NSF) will be accessed $25.00 service charge. All payments must be in U.S. currency. 7. Cancellation Policy Ranes Consulting reserves the right to cancel service at any time. All fees paid in advance of cancellation will be prorated and paid by Ranes Consulting if Ranes Consulting institutes its right of cancellation. If cancellation is caused by a customer's violation of these policies, then no refund will be disbursed. Customers can cancel service at any time and be refunded any amount exceeding the prepayment of the current month. Accounts can be canceled by calling (209) 667-1430. Payment will be made by check or money order within 30 days of receipt of cancellation. The account will be canceled at the end of the current billing period, unless a date of cancellation is specified. Ranes Consulting will not be responsible for any damages your business may suffer. Ranes Consulting makes no warranties of any kind, expressed or implied for services we provide. Ranes Consulting disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Ranes Consulting, its employees or Ranes Consulting’s service providers. Ranes Consulting reserves the right to revise its policies at any time without prior notification. 8. Money Back Guarantee Try our hosting service absolutely risk-free! If you wish to cancel your account for any reason within the first 30 days, you will receive a full refund for all monthly hosting services. This offer applies to the initial contracted term and does not include setup fees. 9. Hosting Referrals If you refer another customer to Ranes Consulting for web hosting services, you'll enjoy a free month of hosting for your web site. Your free month will be credited upon receipt of fees for your referral's first month of hosting services. Refer multiple customers for multiple free months! |
